These Terms of Use (“Terms”) govern your access to and use of the Sum AI mobile application for iOS and Android (the “App”) and related services (collectively, the “Services”), provided by 42apps LLC (“we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms
By using the App, you confirm that you have read, understood, and agree to these Terms. If you use the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility
You must be at least 13 years old, or the minimum legal age in your country, to use the App. By using the App, you represent that you meet this requirement.

3. Account and Access
Some features of the App require creating an account. You agree to provide accurate and complete information and to keep your login credentials secure.

You are responsible for all activity that occurs under your account. We are not responsible for unauthorized access caused by your failure to protect your credentials.

4. Description of Services
Sum AI provides AI-powered speech-to-text transcription, summaries, and note creation based on audio or text provided by you.

You acknowledge and agree that:
  • AI-generated content may contain errors or inaccuracies
  • Transcriptions and summaries are not guaranteed to be 100% accurate
  • The App does not replace professional, legal, medical, or business advice
You are solely responsible for reviewing and verifying all generated content before relying on it.

5. User Content
You retain ownership of any audio files, text, or other materials you upload or submit to the App (“User Content”).

By using the App, you grant us a limited, non-exclusive, non-transferable license to process your User Content solely for the purpose of providing and improving the Services.

You represent that you have all necessary rights and permissions to upload and process such content, including consent from any recorded individuals, where required by law.

6. Privacy
Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to such processing.

7. Subscriptions and Payments
Some features of the App require a paid subscription (“Subscription”).

Important details:
  • Payment is charged to your Apple ID or Google account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Renewal charges are applied within 24 hours before the end of the current period
  • You can manage or cancel subscriptions through your App Store or Google Play account settings
We do not manage refunds directly. Refund requests are handled by Apple or Google according to their policies.

8. Intellectual Property
All rights, title, and interest in the App, including software, design, text, graphics, logos, and functionality, excluding User Content, are owned by 42apps LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or exploit any part of the App without our prior written permission.

9. Prohibited Use
You agree not to:
  • Use the App for illegal or unauthorized purposes
  • Upload content that violates intellectual property, privacy, or other rights
  • Attempt to disrupt, damage, or gain unauthorized access to the App or its systems
  • Use the App to develop or train competing AI models without our permission
We reserve the right to investigate and take action against violations.

10. Disclaimer of Warranties
The App and Services are provided “as is” and “as available,” without warranties of any kind, express or implied.

We do not guarantee uninterrupted operation, error-free performance, or the accuracy of AI-generated content.

11. Limitation of Liability
To the maximum extent permitted by law, 42apps LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the App, including loss of data or reliance on AI-generated output.

Our total liability shall not exceed the amount you paid for the Services during the twelve months preceding the claim.

12. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if required by law.
You may stop using the App at any time.

13. Changes to Terms
We may update these Terms from time to time. If changes are material, we will notify you through the App or other reasonable means. Continued use of the App after changes become effective constitutes acceptance.

14. Governing Law
These Terms are governed by applicable laws without regard to conflict of law principles.
